pursuant to Art. 13 of EU Regulation no. 2016/679 (hereinafter “GDPR”), on the protection of natural persons with regard to the processing of their personal data.
Purposes and legal basis of processing
Your personal data are processed by our Company for purposes connected with or instrumental to the performance of candidate search and recruitment. The legal basis is the need to pursue the above purposes and consent is necessary only for data concerning health, such as belonging to a protected persons category.
Data storage period
Your Personal Data are used for selection activities and will be kept for a maximum of 24 months, after which they will be destroyed or made anonymous.
Providing your data and the consequences of refusing to provide your data
Providing your data is necessary in order to carry out the above purposes and if you do not provide them our Company will not be able to assess your professional profile.
Categories of recipients
Solely for the purposes specified above, all the data collected and processed may be disclosed to internal figures authorised to carry out processing as part of their duties, and to the following categories of external parties:
- any companies (including subsidiaries, parent companies or affiliates of Fassa S.r.l.) or third parties involved in the candidate search;
- professionals or service companies operating on behalf of our company;
- Doctors’ offices in fulfilment of the obligations regarding health and safety at work.
These recipients, where necessary, will be designated as data processors under an appropriate contract or other legal document.
Transfer of data to a third country and/or international organisation
For specific needs associated with the pursuit of the purposes specified above, some of your personal data may be transferred to non-EU countries and/or organisations. On a case-by-case basis, grounds for the lawful processing of personal data may be represented by:
- the existence of adequacy decisions issued by the EU Commission for certain countries that guarantee the same level of protection for the transferred data as that guaranteed in the European Union;
- the need to fulfil the obligations relating to the employment relationship, or the need to fulfil the commitments, including contractual commitments, undertaken by the Company in your interest and on your behalf or, lastly, to pursue the legitimate interests of our Company.
Rights of the data subject
The Data Subject has the right to ask the Joint Data Controllers for access to his/her personal data and to correct them if inaccurate, delete them, or restrict their processing where the conditions are met to do so, or to object to their processing for legitimate interests pursued by the Joint Data Controllers, together with the right to portability for any data provided personally, only if subject to automated processing based on consent or based on a contract, as well as the right to request a copy of the key content of the agreement between the Joint Data Controllers. The Data Subject also has the right to withdraw his/her consent for the processing purposes that require it, without prejudice to the lawfulness of any processing carried out before said consent was withdrawn.
